SCS SB 355 -- ADMINISTRATIVE FEE FOR THE SALE OR LEASE OF A
VEHICLE

COMMITTEE ACTION: Voted "do pass" by the Special Committee on
General Laws by a vote of 13 to 0.
This substitute allows motor vehicle, powersport, and boat
dealers to charge an administrative fee of less than $200 for
storing and filing forms related to the sale or lease of a
vehicle. The administrative fee must be charged to all retail
customers and be disclosed as a separate itemized charge and
include a disclaimer to the customer that it is not a legally
required fee. If the courts rule that administrative fees
charged in compliance with this section are the unauthorized
practice or business of law, no person who paid an administrative
fee may recover the fee or damages and no person who charged the
fee will be guilty of a misdemeanor as provided in Section
484.020, RSMo.
FISCAL NOTE: No impact on state funds in FY 2010, FY 2011, and
FY 2012.
PROPONENTS: Supporters say that the bill clarifies that dealers
may fill out, file, store, and charge for common sale and lease
agreements for their customers.
Testifying for the bill were Senator Dempsey; Missouri Automobile
Dealers Association; Missouri Power Sports Dealers Association;
Lake Ozark Marine Dealers Association; and Mike Kehoe, Missouri
Automobile Dealers Association.
OPPONENTS: There was no opposition voiced to the committee.
